Step 3: Petitioner Must File with Division of Liquor Control
The first thing the petitioner must do upon receipt of the information from the board of elections is notify the Ohio Division of Liquor Control of the petitioner’s intention to circulate a local option petition which may affect existing permit holders. Remember, all Petition Process 1 petition forms will affect all existing permit holders within the precinct where the local option petition is circulated. This provision is REQUIRED for all Process 1 Petition Forms with the exception of Forms 5-P, 5-Q and 5-T when the petitioner intends to change the status of a dry portion of a precinct to wet utilizing a limited effect local option question.
The petitioner MUST, not later than 55 days before the petition filing deadline (equal to 145 days before the date of the election), file this notice with the Ohio Division of Liquor Control, Department of Commerce, 6606 Tussing Rd., P.O. Box 4005, Reynoldsburg, OH 43069-9005 containing the following information:
- Form 5-I, “Special Instructions for Petitioners” as furnished to the petitioner by the board of elections; and
- The list of street names and inclusive numbers as furnished to the petitioner by the board of elections.

Not later than 15 days before the petition filing deadline, the Division of Liquor Control will supply the petitioner with a list of the names and addresses of permit holders who would be affected by the election. The list will contain a heading with the following words:
